My question involves personal property located in the State of: Florida. My home owner neighbor and I have a big confrontation. We have a open yard between our very close homes with 5ft thick hedges and has to be kept 5ft by HOA rules.
My hedges are in his and mine property line and I can't cut the back side (barley a foot) or top back without stepping on his property, barley a foot wide.
He came out and with vile language and threats not to step a inch (literally) on his property. He drinks and is a yard manicure freak, but he's purposely harassing minute issue. His wife, estranged wife, never seen is on HOA board also.
HOA rules requires me to keep the hedges 5ft but I can't teach the 6inches of the top back side or back from my side . There is no fence open lines.
Now, after I called the cops and they are involved today after he came out cussing etc,again said I had to literally go to his door and ask permission every time I cut them. The same routine I've done for 6 years leading this home.
My question is, if I feel threatened by this man and want no interactions with him (much less go to his door) can HOA fine me and force me to ask permission each time?? I told him I want one permission to cut specified area that takes 2 minutes to cut and pick up leaves, but insisted to officers and myself, no, I had to go to his door and ask.
What rights do I have in presenting to HOA and it will look awful if they are not trimmed as it's a front yard hedge divider?
He has a bad temper and drinking problem and I refuse to go on his property other than cut hedges of my side but no I can't with out stepping on literally 1 foot of his grass. That's how bad this old guy is. Help please? Best, Jason
