My question involves labor and employment law for the state of: New Mexico
I had foot surgery 5/27/2016 and was not released to return to work until 7/10/2016. I had no new rehire notification only a verbal to return and work the 2 shifts on 7-14 and 7-15.
I was terminated from the Hospital 6-27-2016 due to lack of FMLA but never received this notice until hand given copy on July 8, 2016 when I found this out by going to eye doctor July 6th for my son and told there was no insurance benefits it ended June 30.
I was contacted by HR and told I had to pay insurance premiums by close of June 30 day. I did pay for insurance benefits on June 30 at 420pm almost $300.00. I do not understand how I was terminated on June 27 yet I was contacted and I paid for benefits / insurance on June 30 at 4:20pm with Payroll and HR. When I called HR no one nor the CNO would answer my calls or texts so I drove 2 hours to HR I was then hand given the termination letter dated June 27. They had stamped it delivered July 8. I waited over 3 hours to speak to CNO who told me I would be getting this termination letter but to bring in doctor note to return to work and I could work July 14, July 15 and new paperwork would be done. I had a meeting with the CEOper his request (that CNO confirmed at 0730am prior to my drive) in which I drove 2 hours again to meet with him and he cancelled and couldnt meet I was told it would have to be rescheduled for next week.
I was told I to work 7-14 and 7-15-16 then was not scheduled and any further days I called and sent many texts messages to the Med Surg Director and CNO with no reply to further work.
I actively started looking for work and was offered position at Eastern Idaho on July 22, 2016. This required relocation we left NM 7-26-16 that took 3 days on the road and packing and unloading with setup. We moved into apartment on July 29, 2016 but had no internet connection at home until week later. We used library for internet resource that was limited to 1 hour per day which my online schooling and studies took more than the allotted time per day. I was locked out of the online reporting system and sent request to reset so the delay in reporting. I will complete Masters degree with Grand Canyon University in October 2016.
I am seeking unemployment from 7-16-16 through 8-13-16. I had no work from July 15 through August 15, 2016. My return to work date 8-15-16 but no paycheck until September 2, 2016. I am very behind in bills and have been to the local food pantry for food. I have no money for gas and the HR Director gave me $20 for gas so I could go to work We are having a very difficult time and even applied with Idado for SNAP and other benefits but will not be able to received benefits until September when we will have a paycheck and income again. My teen kids will start to school 8-24 and I have nothing to pay for their lunches, no school clothes nor haircuts and no school supplies as we are counting change to buy gas so we can get to work. I really need to resolve the denial as soon as possible. I contacted unemployment and they are fighting it and I have an appeal date set for September 12 with the hospital. They are saying I was dismissed for tardiness, I have texts that I sent to my Director and the CNO where I was asking about further shifts without any reply except to speak with the CNO. Noone even HR would not return calls. I have taped conversation with the CNO telling me she was going to put my into Director position but I had to meet with the CEO first.
I worked 2- 12 hour shifts from 7-4-16 thru 7-16-16 at Artesia General Hospital. There was no work from termination date 6-27-16 until the return to work release note on 7-10-16 I worked (2)- 12 hr shifts on 7-14 and 7-15. There was no work until August 15, 2016.
I applied to many NM places during this time (Lea Regional, Nor Lea Hospital, NM State, Home Health, and many more).
I was contacted by nurse recruiter in Idaho and this is where I was offered the fastest return to work on 8-15-16 of a full time job.
