My question involves a consumer law issue in the State of: Iowa
I purchased my vehicle 5 months ago from a buy hear pay here, and I pay an extra fee every month for a warranty that if something goes wrong on my vehicle, I pay for the part and they are supposed to fix it for free.
About 2 months into having my vehicle, after parking my car it wouldn't start again for about 45 min to an hour after I shut it off. Then it ran fine until the next time I shut it off and would have to wait the 45min to an hour. I took it to a few personal mechanics and an auto parts store for the diagnostics. Every person I talked to said it was an O2 sensor or something with the camshaft. When I first talked to the dealership after they looked at my car, they believed it was the same thing. After having it a week (which they claimed it would be back to me in 48 hours) they said they were still trying to figure out what was wrong. At that point I asked if they had a vehicle that I could drive to get to and from work in the meantime. The gave me a car that leaked gas all over. Stating this wasn't safe, I brought it back a few days later and was given a vehicle to drive that had a check engine light blinking and felt like it was going to give out while driving. After a few days, they tightened the connectors to the battery and sent me on my way. The vehicle is still doing it, but I was told, "we usually don't give out rental cars, so its not our responsibility." Keep in mind, I have to put my son in this vehicle and drive on the interstate every day, so it is not just me that they are putting in danger by placing me in this vehicle.
On the 3rd Week, I was told that they might have to put a new engine in it. I told them I didn't understand because it had been running, and nobody had thought it was that. Their response was that I had to replace the engine, no matter what I wished to do with the vehicle. So I told them to let me know when they found an engine. A few days later, I went to make a car payment and was told that they were in the middle of putting my car back together with a used engine. I was never notified when they found an engine, and I definitely didn't give the ok for a used engine, as I know that they can come with a whole new set of problems. I feel like I am stuck now. I have no proof that they actually replaced the engine and that that was even the real issue. They still have my vehicle, going on 4 weeks now. I don't know what to do at this point, I feel like I am being scammed and don't know the laws well enough to speak up. Please help!
