My question involves landlord-tenant law in the State of: CA
We live on a ground floor condo and recently had a neighbor move in behind our unit last year. From the day he moved in, this person has been complaining NON STOP about "noises" from our unit and falsely claims that these happen even during community "quiet hours". My son takes a prescription sleep medication and is fast asleep between 9 pm to 7 am. There is NO way there are any noises in my unit - I need my sleep and am usually too exhausted to stay up so there's nothing on after 9 pm (including during the weekends). One time, I asked him what noises and he claimed that someone was bouncing a large ball against the wall (that his unit and mine share) and that the TV is always on too loud. I asked him to come in and show me where there was a large yoga ball in my unit and he kept quiet and claimed it may have been the upstairs neighbor !
He has also given dates and times when I can vouch that we are NOT home as times when there was excess "noise".
I have told the landlord that these complaints are harassing and the portion about noises during quiet hours is MATERIALLY FALSE. My autistic son with ADHD (on meds) occasionally can run a lot, during the day time, but we have arranged for a trampoline for him on the patio, take him swimming during the afternoons to tire him out, and have rearranged our furniture so that he does not bump into the shared walls with this neighbor or bang his head against those shared walls.
Despite this, I have received yet another noise complaint warning letter today. I am really upset. Aren't we allowed to live our lives ? We have tried talking to the neighbor to no effect. He says he only moved here because it is a quiet complex, works out of home every day and needs absolute silence to do so. He doesn't know or care what autism / ADHD are.
Please help. Can they ask us to leave because of this neighbor ? What are our legal options if we're asked to move based on this person's complaints ?
