My question involves landlord-tenant law in the State of: Texas.
The home I have been renting for 9 years has a back deck that sits about 3 or 4 feet above the ground. The deck is deteriorated to the point that some of the nails that secure it to the house have been pulled away. The platform is no longer level and the railing on the deck moves back and forth. I have made a maintenance request two times to get the back deck repaired because I feel like too much weight on the rails will cause them to collapse, jeopardizing the safety of my kids or myself. The maintenance request has been read and ignored. After 2 months of no response i decided to submit a letter, certified mail, to terminate my lease one month early and have given a 30 days notice. I assume under Texas Property Code 92.056(f) that this would be a health and safety hazard and my termination is justifiable, but 92.056 is vague in what is considered a health & safety issue.
The property manager responded as if I was not legally able to terminate for this reason.
Looking for advice, am I in the right or wrong on this situation?
