My question involves real estate located in the State of: California
Neighbor installed a power pole near property line. The power pole is a "customer owned" (i.e. it's not owned by the utility) pole. When my neigbor installed the pole in 2007, my property was undeveloped (we are in a rural area, my property was an orchard. I recently surveyed my property in preparation to build a house, and learned the cross bar at the top of pole and power lines encroach on my property by up to 5 feet. I have no rights to this pole and no easements are in place. The power pole facilities serve only my neighbor (no other properties are served by this facility. What recourse do I have? Is this a prescriptive easement in favor of my neighbor through adverse possession? They have not been paying taxes on the portion of property their facilities encroach? The local utility has indicated it's not their facility.
