My question involves a traffic ticket from the state of: California
Hello, all, I am new to this forum. 2 days ago while driving my daughter to an appointment I mistakingly passed the entrance to the dental office lot we were going to. A little further on the same street, I entered the "center left turn lane" (yellow lane broken on the inside, solid on the outside) and made an u-turn to return to the way I came from. There was motorcycle cop on the parking lot on the other side of the street (towards the u-turn). I saw the cop, but without hesitation made the u-turn thinking it was a legal coming from the center lane. I was puzzled when he stopped me to say I made an illegal u-turn in a business distric (CVC 22102 I was also confused as to consider the area a "business district" when there are residences and businesses in the area.
Please note there were absolutely no cars coming when I made the u-turn. Also, there was no sign saying that an u-turn was not allowed. This is an area I drive daily and I see drivers making u-turns often, as there are no close intersections to turn within a reasonable distance.I believe that mostly, people assume it is ok because of the yellow center lane. I have a clean record of 30 years driving, and would never do something illegal right in front of a cop, and even more so, in front of my daughter. It did not help that the cop was rude and authoritarian when I was polite the whole time.:grumpy:
I researched the law about u-turns on business districts and have some questions so that I can prepare to defend myself in court. Can the yellow "center left turn lane" be considered an "opening in the barrier designated and intended by public authorities for the use of vehicles or through a plainly marked opening in the dividing section." as stated in VC 21651? Any other suggestions that may help my case? I was not succesfull attaching a google picture to illustrate the area.
