My question involves real estate located in the State of: West Virginia
I have a nuisance neighbor that has been harassing me since I bought my property. I have an old gas well road through my property and I fully intend to fence it off with a gate and run livestock. The neighbor is threatening to take me to court and force me to give him a right of way through my property to his. He has full access to his property around his Father in Laws house, but since they don't get along he wants to go through my property. He also says that I will have to remove my gate because he doesn't want to have to open and close it all the time. My question is can he do that to me because he can't get along with his family? Also, my property is financed for 20 years, so how could I legally give him a right of way, when I don't yet own the property out right?
