As part of a child support case, my ex husband was required to turn over his tax returns to my attorney. In the returns, it was discovered that he claimed the public educator deduction of $250 on his taxes for his "spouse". He did this after we were divorced (and he even filed "single" on his taxes, yet claimed a deduction for a spouse?) and he has my name and SSN listed on the portion of the taxes for student loan interest. He didn't take a deduction on this portion, but has my information listed. My name shouldn't be anywhere on his taxes, nor should my SSN, and he definitely shouldn't be claiming my deduction for my classroom expenses. I printed off the form 3949-A and filled it out. I'm obviously irritated that he is trying to claim my deductions, but is this the right type of situation to file a complaint with the IRS, or are they not going to care about this measly $250 deduction?
