My question involves criminal records for the state of CA:
It appears that I may have a successful 851.8 motion.
I have a few questions that I’m having a hard time getting answered:
1. After 3 years, how to I know the arrest record is physically destroyed? Does the arresting agency provide proof?
2. I’ve been told the FBI may or may not honor the CA DOJ amendment of its RAP sheet. Has anyone seen this to be true?
3. Will the National driver registry honor a 851.8 if a Action was made against a DL involved in the crime the 851.8 is being granted for?
4. What other powers can a 851.8 be used for? Non court online search engines for an arrest?
