My question involves a child custody case from the State of: Connecticut
My ex and I have joint custody and joint residential. We have 4 kids, the oldest being 18. My 15 year old has been wanting to live with me for a little more than a year now
I told her she needed to give it time to think when she 1st broched the topic last year.
She wants to move in do to the volitial relationship her mother has with her step dad. There is a lot of fighting to the point that the police have come 3 times in the last year alone. She is very depressed there and has feeling of committing self harm and doesnt not feel safe due to mental abuse from her step dad. My 18 year old backs up all the claims of my 15 year old. The 18 year old wont leave because she is afraid for her mon. She calls me from there crying on a regular basis.
She told her mom and she agreed to give her a little space, but wants her to come back Its been 2 weeks.
I have asked to talk with my ex about it but now she said she is going to file me in contempt if she is not back. My daughter wont go back and breaks down every time her mom tells her to.
I understand her being here in in violation of our custody agreement, but I cant have my daughter in harm's way .
I am filing for custody as soon as the court opens, but what do I need to know? What should I expect?
The kids are homeschooled currently, but are all very behind. I was able to get thec15 year old into a magnet school if she does live with me but her mom told her "over her dead body" in a text.
