My question involves a child custody case from the State of: MO
What is likely to happen in court if Ex refuses to administer prescribed meds and/or objects to me giving the kids prescribed meds? Most recently, the issue involved a prescribed antibiotic, and he even called the police to try and make me stop the antibiotic. The police did not file a report or advise me to stop (in fact, they recommended that I file a restraining order after reading the texts my ex sent right before making the call).
Prior to this, he has refused to administer prescribed allergy meds, prescribed asthma inhaler, etc. He has administered the aforementioned meds zero times.
I have primary residential. We have joint legal and are supposed to "confer about major medical decisions", according to our court docs.
His reasons for refusal include "the kids don't need it," "they aren't really that sick," "allergies get cured by exposure to allergens." I've provided doctors' reports and test results multiple times, but he still insists the kids don't need the meds. Sometimes he even insists the results are wrong. For example, he keeps texting me claiming the kids never had strep throat and that I medicate them for no reason, but the doctor told me they called him several times and tried explaining the kids DID test positive for it.
The kids' doctors are frustrated because ex keeps calling up there and yelling at them. They had to take the kids off the schedule for a while because they were worried he'd go up there and cause a scene. The kids and I used to have a restraining order against him, so that might give you some insight into his personality.
The medication refusal wasn't as big of an issue in the past because he was only showing up a few times a month, but for the past couple months he's actually been following the custody agreement from years ago because he is gearing up to take me back to court for custody. He also says he's filing contempt charges against me for giving the kids prescribed meds without his consent. (I'm quoting him about all of this here, not just making assumptions)
Just trying to figure out what is likely to happen with this situation in court. I'm hoping for sole legal custody and a change in the visitation schedule (preferably no overnights - the original schedule before this one didn't allow overnights due to his past behaviors) because I feel that it's not safe/healthy for the kids to get denied access to prescribed meds. There are also unrelated issues/concerns that I feel impact the kids' well-being.
I'm worried the judge will just issue an order telling ex to comply with the meds, and that won't help. He has made it very clear how he feels about conventional medical treatments, and he also brags that the judge will punish me for giving the kids their prescribed meds (allergy, antibiotics, and asthma meds). Ex claims I will lose the kids or get hit with fines for administering the prescribed meds.
