My question involves a consumer law issue in the State of: Texas
This is a real mess. So, I'll make a very long story short.
In March 2013 I purchased a vehicle by a vehicle trade from my mother. I have bill of sale for that. She did not give me the title because, she said, she could not find it at that time.
I later learned that she obtained a title to the vehicle 6 months after the trade, yet did not sign it over to me when I continued to ask. In January 2014, ten months after the trade/sale, she got a title loan on the car (while its in my possession). Throughout all of this time she continued to stall me about the title. Finally, in Sept 2014, she came clean, and promised she would pay it.
Two months later, my mother was convicted on another fraud case. After realizing that she was not going to be able to pay the loan, I contacted the title loan company directly in writing and by phone. I explained this situation and asked for resolution as I did not want to have to file charges on my own mom (who does?), but I was willing to if that is what they required. For over a year, they stalled me on what to do or coming to an agreement to clear the lien; just kept passing the issue from person to person. I recently learned that the company was dissolving their title loan operations in my state at that time. Hence, the indecision, and later, radio silence from the company. In that meantime, sadly, my mother passed away.
So, my vehicle has a lien from a loan that I did not get, by someone who did not own the car, and the loan company is refusing to release the lien unless I pay 10% of a dead woman's loan; on a title that 3 years ago they knew was effectively stolen.
Other that being on the hook for the 10%, which I cannot afford, is there anything I can do?
