Service Providers: Overcharged Credit Card for Smoking in Non-Smoking Room

My question involves a consumer law issue in the State of: California
I am currently staying in a hotel for 1 week with my husband and 17mo old baby. The first night we stayed in a non smoking room as requested, in the morning 11:15am the owner comes and asked when we are checking out (check-out 1pm) I told the owner my husband's boss will be calling to pay for another day, she then says ok and leaves. She comes back 30min later and says the room is payed for 1 week then follows with "you smoking in room!!??" I open the door wider and show her my baby on bed and say NO WAY I dont smoke! She then says ok and leaves. Around 3pm I get another call from owner stating we needed to change rooms because she doesnt rent out "non-smoking rooms for long stays " i said I have a baby and I need a non smoking room. She is insistent we leave to other room and basically I have no choice. The room she gave us was horrible! It reeked of an ashtray! I went to owner and asked for a diffrent room and explained again my baby cannot be in that room, She sent us to an even worse room! My husband comes back from work and says the owner called his boss who is paying for our room and said I was smoking in the room and she doesn't have to give us a non-smoking room since she supposedly caught me and charged an additional $160 to his credit card! Of course he was upset! How can we fight this since the owner is doing this? She has no proof at all i was smoking, I dont smoke! Plus can she really make my baby stay in a foul smelling smoking room? We are currently without a home and my husbands boss is helping us so i would not do anything to disrespect this man!
