I have put in an order for items at an online store.
I seen the price of said items at $7.95 each normaly there around $40 or so. Thinking it may be a miss price or error I contacted there online representatives and asked if I ordered the item would the items be shipped when they came in as they were on back order and if i would be paying the advertised price. The representative stated they would ship the items and they would honor the listed price.
I then and only then after getting confirmation from there representative placed my order. I got the order confirmation in my email with what I ordered and the totals to be charged to my account.
A week or 2 went by and I sent in an email asking if they have shipped my items out yet or if they have got them in stock as of yet.
They replied that my order would be shipped once they were in stock.
Another week or so went by and i got an email stating that they made a pricing error and have cancelled my order and refunded any charges made to my account.
This company is based in CA. I am in NC.
I have screen shots of the conversation with there representative, of the price when ordered, and the emails between us.
Do they have to honor the advertised price being I went the extra mile in contacting them to make sure the price was correct and they telling me that the price would in fact be honored before placing my order?
As I'm not sure if they were selling the items at that price before they were out of stock and that when they got in the new items that there price changed. Or if it was a mistake on both the person listing the item and the person that told me they would honor the price.
This would fall under the bait and switch would it not?
