My question involves landlord-tenant law in the State of: California
I allowed an acquaintance to occupy one room in the house I own while she arranged to move out of state. Our original agreement was to allow her to stay for one (1) month, but she has repeatedly asked me to extend that one month to another month, to another.....it is now months later, and she still won't move out, even after I formally terminated her "lodging" agreement (lawfully) with proper written notice. Under the terms of that notice agreement, she was to vacate my home yesterday - and she's still here and now won't leave.
I have told her I have contractors coming to begin renovations on her room (the truth), and I need her to leave, but she still refuses. She claims she has "spoken to the local police and a lawyer, and they say she can stay as long as she wants." I have spoken myself to law enforcement and they claim this is a "civil" matter and refuse to intervene and remove her.
I say she is now a trespasser as defined under Penal Code section 602.3, and am hoping I can get local PD to see it as such, but they are famous for their inaction and not knowing relevant law. What do you all think?
