My question involves the Dependent Administration in the state of Texas.
The Personal Representative has requested and the Probate Court has approved a Partial Distribution with an equal Decrease of the existing Bond.
However the Court has accepted the presented decreased Bond without the prior distribution to the heirs, which is still pending.
QUESTION: Is this procedure legal or should the bond be decrease AFTER the partial distribution and not BEFORE ?
As far as I know a bond can be decreased/withdrawn only after the risk covered by the bond is removed and not before.
