My question involves real estate located in the State of: Pennsylvania
We bought a piece of land to build a home. When we were laying out the home on the site, things didn't measure up to match the deed. After having the land surveyed by a registered surveyor, we found the neighbor had placed a fence on our side of the line by more than 6 feet. The surveyor found 3 of the 4 existing pins just under the surface of the ground. We talked to them and gave them a copy of the survey. They think we removed the old pins and installed new ones. We sent a demand letter asking for a commitment letter to remove or relocate the fence. Also in the demand letter we gave a date to have the fence removed or relocated. The are not willing to act to have the fence moved. My question is as follows. In Pennsylvania can we legally remove the fence that was erected by the neighbor on our land? If so, do we need to notify them again?
