Fences and Walls: Old Retaining Wall--Unseen Base is Over the Property Line, Now Being Replaced

My question involves real estate located in the State of: NY

During the neighbor's excavation to replace a 50 year old retaining wall from their dig-out, the surveyor came and found the newly-exposed wall base/unseen portion (fill and drainage) was over the property line on one end of the wall.

Seeing as how the wall is holding in our land at the base of a hill and a stand of trees on the hill, we don't want the old section that is on our property to be dug out from under the trees. We'd prefer the new wall be constructed entirely on the neighbor's property leaving the old stable section under the trees in place.

The wall was not supposed to be on our property at all in the first place, and there's no reason for the neighboring property not to host the entire new wall as it is being built.

Is there any way we can make sure they don't build on our property again?
