My question involves a child custody case from the State of: VA
We went to court back in April. We did not talk to a judge but a court assigned mediator who then presented our case to a judge and a judge approved everything. But it's not going so well. My ex refuses to give me his new address, which he is supposed to per court order. He uses his parents address for courtpaperwork. He is also not very good with the pick up as he comes a day late and even then sometimes hours after new agree upon pick up time. My biggest issue is the child support though. Starting in September I wont depend on it anymore as my daughter is starting Kindergarten but until then I do. He has 6 years to pay back his arrears (which I think is riddicoulous) but I was ok with it as long as he would pay his monthly payments. He is supposed to pay a little over $600 a month and he has paid so far $900 the whole year. Court order was sent out in May. He lives a nice life so its not that he works 2 jobs and barely makes ends meet. He works as an independent contractor so no garnishment possible
I would like to go to court and get something started to show how serious it is that he needs to pay. I know I need to file a motion for non-payment with the court. How soon can I do that? Can I already do it now? Can I have the court make him give me his address? I might not need it for anything specific but I think it would be good to know for the future or if I want to serve him with anything else in the future...
