My question involves real estate located in the State of: California
While building an addition onto our house it was discovered that neighbors patio covering was 5ft over our property line. We need it taken down so we have room to put siding on the addition. We also discovered it was not a permitted structure. Along with that, his wood pile and other items are on our property. We notified neighbor that the structure needed to come down and the items he was storing needed to be moved off our property and he said he would take care of it after property line confirmed. We provided a copy of our survey. Then he went back on his word. We redid our survey and confirmed the encroachment. He refused to accept our survey. Completed one of his own which had the same findings.
We reported the illegal structure to the county. He was notified to take it down. He subsequently took out a permit for removal of the structure. Fast forward 6 months and nothing has been done. County said permits are good for 6 mo to 2 years as long as there is activity. I feel that he is going to continue to drag his feet. Our permit was extended because we are unable to move forward to complete our project. The county will only let it go so far before we incur additional costs for new permits.
My questions are:
1) can we remove the structure for him? Especially now that he has submitted a permit for removal?
2) can we move all the items he is storing on our property?
3) would sending a certified letter accomplish anything legally?
