My question involves a consumer law issue in the State of: Texas
Hi, Ive posted before regarding trouble with my contractor, we signed a contract with him in January for a project building a screen room and extended patio on our property. The contract said project would be completed by 2/11/18. So here we are beginning of May and it is STILL not completed! Weve had several confrontations with him over this and the poor quality of workmanship over the last few months, all to no avail. This past Saturday he sent an email saying he was going to sever the contract because we complained. So he left us with at a lot of the work undone and some that has to be redone because of it being done incorrectly ie: electrical problems, severed sprinkler pipes, tiles installed and left with grout on them for weeks because his guy never showed, then sealed with the grout haze still on! I just got 2 quotes for $3400 to fix the tile, $600 for sprinkler repair, and thats just the beginning! We still owed him the final 10% of our payments to him which is approximately $4000.
So now my question am I still obligated to pay him even though he severed the contract? Should I pay and then try to take him to court to recoup my losses? I hate to pay for reapairs and then still have to pay him, but he has threatened to put. Lien on my home if I dont pay!
