My question involves criminal law for the state of: Maine
Hi,
I'm doing research for a book I'm writing, and I'd really appreciate your help.
In the book, a character is arrested for a criminal offense. During the arraingment, a trial date is set and he is released on bail.
Then, before that trial takes place, he is arrested again for a far more serious crime.
My questions has two parts:
1) Would he face arraingment for the second arrest if he's already been arraigned once for the prior, ongoing one? (I know, this is the wrong place for this question, but I'm grouping it with the next one.)
2) Can the prosecution successfully argue that for this crime, he is a danger to society and needs to be incarcerated, despite the fact that they released him on bail for the other arrest?
Thanks
