My question involves a child custody case from the State of: New York
I have partial custody and joint legal custody of my kids who go to school in Queens NY; I live in Philadelphia. The school has a copy of my custody order but seem to either be favoring mom, who is hostile to me as a father or perhaps they just do not like me. my present challenge is my 11 year son very much wants me to accompany him on school trip tomorrow, May 16th, but school just informed me yesterday that I cannot attend or even visit him in school because it is outside of my partial custody periods, which are all outside of school hours. They claim that they are denying my request to accompany son on school trip after having spoken to school district attorney who they claim says that my custody order has to specifically say that I can visit my kids during school hours, in order to be able to attend school programs or trips or pick them up from school.
Can anyone give me someone ammunition that would prove by NY state / city law or policy, that my custody order does not have to explicitly state that I can visit my son during school hours or pick him up from school in order for me to be able to?
The trip is tomorrow so, this is very time sensitive and so would be grateful for speedy responses that are based on statute / law / or guidelines that I can present to school to buttress my case.
