My question involves landlord-tenant law in the State of: Massachusetts
Good Afternoon,
Thank you for your assistance. My ex-girlfriend and I moved in together July 7, 2017. She had an affair and moved out in October. We're both on the lease. We made amends and she moved out amicably. My best friend of sixteen years who we both served together in the military moved from Vietnam to get a fresh start here in America. He moved in mid-October when my ex-girlfriend moved out. She and I subsidized his rent for three months; while, he attended Salesforce training. He completed his training in November and received a job offer from my company as a Salesforce Administrator in December. (I'm a military program manager and help veterans find jobs at my company - I was directly responsible for him getting a job with us). I've spent the last six years in multiple capacities helping him find work. I've spent countless hours, re-writing resumes, networking him, and using my extensive knowledge in this space to help him.
He moved in with me in October, 2017. I covered his food, utilities, rent, and any extra's. He has a private bathroom/bedroom in a very expensive apartment. He started work in his new career with my company December 19th. In the last few months, he's become incredibly isolated, angry, and uncomfortably hostile. He smokes a ton of weed in the bathroom (against our lease and against my explicit wishes). He started paying rent in January $1500 a month. He told me in February that he couldn't afford the amount, so I lowered the amount to $1200. We never signed a written agreement (which is my stupidity). He paid in February/March. During March, he quit communicating, cleaning, and created a silent, unhospitable environment. I've asked for multiple conversations and he's repeatedly told me he doesn't want to speak and cursed at me several times via text/real-life. I've told him that I don't appreciate him cursing at me and it's become a silent zone for two months.
3/17 - I went out and had a few drinks with my friends and my dog had an accident on my carpet. I came in at 2 AM and had to clean up and it woke him up (he didn't tell me). The next morning he said that he was moving out and he doesn't give a "fu%&" about communicating about the rent/tenant responsibilities.
3/19 - I sent him an email and a text saying that since he didn't give me a 30-day notice and he's moving out April 1st and that he owes me pro-rated amount of the rent for April. (He asked if he could purchase my bed and playstation 4). I told him yes, with rent - the total is $1060. He never responded back.
3/24 - I asked him verbally to confirm if he's going to pay rent and he said for me to go fu^& myself and that he wasn't paying rent to 4-19. I sent an email on 3/19 with a 30-day notice, since he hasn't sent me anything. In text, he said, "I tried to move out in February and March, but I felt bad, I no longer feel bad, I'm leaving April 1st and I don't want to speak to you about it. I gave him several options including keeping the apartment and I'll move out (I'm potentially leaving for San Francisco, May 15th for a relocation.)
I know it's a lot of information and I've been as clear as possible - I kept all texts/emails, etc. Once again, we do not have a written lease.
Out of principle, I want to get what is due me. My questions are, as such: 1. Do I have a claim - in small claims court in MA? 2. Is this worth it - he is screwing me a bit financially, but I can afford it, though out of principle, I want my pound of flesh - since I subsidized his life and career. 3. If I take him to small claims court and win - this will directly come back to my current employer and I don't want that black mark on either one of us.
I'm trying to do the right thing - ideally, he would just stay, I relocate and the lease ends in July and we permanently end our relationship.
FYI - I turned off the wi-fi and cable - that's not my responsibility to provide, I think. Any help would be appreciated.
