My question involves estate proceedings in the state of: California.
Hey so my question is... can a trust be modified if circumstances have changed ? my grandfather left some assets to a trustee for my mothers care and benefit. he was scared my dad was going to try and sue my mother for assets as they were separating. so he setup this trust to protect her from him.
they weren't legally married. just common law marriage. partners.
now its been about 11 years since the trust was written as well as how long my mother and father have split.
since its been so long since the separation and the threat isn't present, can she have her assets be given to her instead of having to deal with a trustee. the 2 other beneficiaries get their assets outright.
