My question involves landlord-tenant law in Nassau County (The State of New York);
Until recently, I rented an apartment (the second floor of a mother-daughter) for about 5 years. When my lease expired after the first year, I kept living there at the same rent. Then, when the rental was controlled by a management company, I was asked to sign a new one-year lease (with a rent increase) and the option for a two-year extension. It made perfect sense, so I signed it.
The only stipulation in this new lease was that I would have to vacate if the owners decided to sell the property. But I was assured it might not be sold for a long time since the identical home next door was on the market forever.
Then, three months into my new one-year lease with a two-year extension, I was informed that they intended to put the home on the market, so I had to vacate in 45 days. [It wasn't sold; they just intended to sell]
When the landlord failed to return my security deposit (which the new lease said was equal to two-months rent), I began researching the home where I had lived for years, only to realize that my kitchen and bath weren't legal and the building owners never applied for any permits.
1. Am I entitled to have my security deposit returned?
2. Does the fact that my rental was illegal affect my security deposit or my ability to sue the landlord for any other reason?
3. About a year before I vacated, there was a fire in the kitchen (in the oven) resulting in the death of three of my animals. Does the fact that I lived in an illegal rental (with a presumably illegal gas oven) affect my rights to sue for damages?
4. If I decide to sue to recover my security deposit or for damages, do I need an attorney?
