My question involves real estate located in the State of: Texas
Our neighbors sold their home 2 years ago to a house flipping company. They rented it this March. When we purchased our home in 2012 our survey showed the property line was over 3 feet on the opposite side of our fence. We liked our neighbors so we let them know about the new fence being installed deep in our property line and our plan to move it one day, allowing them access to it for the time. Property sold 2 years ago, same thing, we loved the renter and let him know about the actual line. The renters moved and the owner listed it as "new construction." We called to let them know our intention of moving the fence and reminded them of the survey. No response. We sent them a letter, along with a copy of our survey, letting them know we would be moving our fence once construction was completed. We have a dog and small kids, having a fence temporarily down next to a construction site is not an option. No response.
Today, the house was torn down. I visited with the demo crew and was informed they will be taking down all the(our) trees on the "fence line," early tomorrow. Our attorney is on vacation and we need help asap.
What are our rights. Can we stop them?
