Modification of Custody: Can Absent Parent Get Custody in a Neglect Situation

My question involves a child custody case from the State of: Ohio

Divorce was back in 2006. Father was designated as the legal custodian of the child because mom's attorney never did any work on the case. The attorney was disbarred. Divorce was reopened and mom was to have visitation. Dad has never answered phone, but the child comes to the mother's home and there is a relationship between them. Child has been at mom's for two months with no contact from dad. He has not answered his phone or door. Mom has contacted police and told them that child is here and that when dad wants her back he can come and get her. She is 17. There has been case with CPS in the past 6 months that resulted in voluntary placement on dad's part. No food, filthy home, no utilities, etc. There are past allegations of abuse from his family and this child. The child refused to talk about it. The child is petrified to be alone and does not want to go back to dad's house. Do I call CPS, file for motion to modify, ex parte order or??? Child has things that need done for school: background check, fingerprints, etc. What are the chances that the court will allow the mom to have custody? Any suggestions are welcome.
