My question involves estate proceedings in the state of: California
Hi all I need some legal guidance on a home/junkyard owned by all three of my siblings. I am currently out of the house and wishing to move in to live
there, but one sibling (#2) wants Me to pay rent. Sibling #4 also wants me to pay rent. I am trying to see what reason I would have to pay rent to two siblings only. I think Sibling #2 will be collecting the rent and I have no idea how the rent will be distributed to all parties. Maybe I am not smart but, if I own some part of the property, why cant I just live on my part and ask for access to the property? Yes I will pay utilities and property taxes as well. If I do agree to pay rent and move in will I need a contract or something that gives me some kind of legal rights while there? Will the contract also state who gets the money and why? Why not all siblings getting a portion of collected rent? Do you see my dilemma with rent payments here? I am paying rent elsewhere now, but it is not a good environment for me. The other Siblings stated the rent funds would go for property upgrade, is this enforceable? There is another
Sibling(#1) who lives in the property now and is being asked to pay rent as well.
I hope this is the correct forum to post my question and if not please let me know and i can copy and paste to another forum section. I just thought that since I am dealing with Heirs of a property that was inherited I could get some guidance. I do not wish that the property gets sold at less than market value right now(even though I have been told the market is up now).
You Guys have helped guide me and save me lots of money in the past and I thank You.
I wonder what this situation is called when Siblings own one property. Is it "Joint tenants in common" or joint owners or some such?
What type of contract would I need for a rental contract of this sort or is that another question for another forum section?
Thank you in advance to all Who help guide me.
Sincerely Matt
