My question involves labor and employment law for the state of: Georgia
I was put on administrative leave. I had 3 boys who were talking a lot in the beginning of class. I told them several times to stop talking and then they started to wrestle on the ground over a backpack. I said the following "We do not roll around the floor. We do not act like crazed monkeys." I sent them out in the hallway where they were talked to by their coach as he was walking by (these same boys had been in trouble with other teachers and we were on day 2 of the school year). At the end of the school day I was called to the office, told to get ahead of this I needed to call the 3 parents, tell them what happened, what I said, and that I did not mean anything offensive.
At the end of the following day, I was told to report to the district office. The next day I was told I was on administrative leave pending investigation. The investigator said to me after I told him what happened that I was a white male and I assume these were African American boys so you know....
The investigation found that my statement of events and what I said were supported by other students. Yet I was informed there was another situation that occurred where I said something about Tampa Bay Buccaneers & Mexicans and a person wearing a TBB shirt was offended. I was not made aware of this offense/situation until 3 weeks after the fact and I have zero recollection of saying anything. However I was wearing a Washington Redskins jersey and I could have been talking about the Redskins (it was during preplanning).
I was told by my Union Rep (which I joined on the day of my Administrative Leave) that the current recommendation is termination (although for the last 2 weeks I was assured I would be given a slap on the wrist and return to the classroom).
Do I have any case here against the School System? Discrimination? Wrongful Termination? The Union Rep said they could only advise me to a certain point since I was not a member when this situation occurred. Any direction, information, and guidance would be greatly appreciated. ALl my performance reviews from my 1st year were excellent and I am not aware of anything in my file that says otherwise.
