I was driving down in the dark on gravel road which are smaller compared to highways and grid roads. I see headlights in the distance and soon after start to move towards the right side of the road in order to avoid hitting them while we pass each other. On gravel roads you tend to drive in the middle until you meet a vehicle of which what I was doing. The lights of the vehicle were blinding so I concentrate to stay on my side of the road. I immediately see a wide open door obscure my lane and then I immediately hit it after.
Insurance says this is at my fault because the vehicle was parked and I was not. But I strongly disagree because I was unable to see the door from his headlights and the dark ahead of time and the door was interfering with my lane. Also from the statement the individual was outside of the vehicle and six feet away from the opened door, meaning that they opened the door to get out and left it open. Am I at fault, is it 50/50 or is it a no fault incident?
