My question involves a child custody case from the State of: Texas
I want to leave the state with my 8 month old son. His father has been abusive with escalating intensity since I gave birth. His father also has a history of drinking and doing hard drugs (cocaine) since baby has come. It's my understanding neither of these matter without arrests, but he has put our son in danger.
Dad works from home and does not have anything tying him to the city we are currently in - the same for me. I want to get us to a safe place (with my family in Louisiana). We are currently living in the house his dad pays for, but I don't feel safe here and have nowhere else to go. His father shows up inconsistently and is abusive verbally when he is here. I feel I need to leave urgently and can not afford to go stay in a hotel while we seek a legal order. It's my understanding the orders do not happen in a day.
Can I leave legally? I understand his father can get an order for our son to return. Unmarried, his name is on the birth certificate and we took a paternity test during the pregnancy. Edited to add that we do not have any custody agreement.
