My question involves court procedures for the state of: Florida and other states.
I have heard that Florida and/or other states have decided to adopt Federal Court guidelines (Daubert) for expert witnesses. If this is true, I would like to know whether an expert can "create" a methodology - this involves automobile diminished value cases - where no valid methodology existed before.
I was deposed today and when the defense attorney asked about my methodology for determining the diminished value of an automobile after collision repairs I told him that I created it.
After the deposition the plaintiff attorney said that he'd forgotten to mention the change in expert witness qualifications and that my answer might be problematic.
I have been using this methodology for more than ten years and it has been instrumental in winning civil cases in State Courts.
