My question involves real estate located in the State of: michigan
I live in a twsp that prohibits chickens, however i own a small flock as do several others in my neighborhood. Nobody cares. My neighbors like them.
Recently ground was broke on a new home on my street. Code enforcement drives my road now weekly.
My birds were behind a chainlink fence, he mustve saw them. He gave me notice to get rid of them within 2 weeks or else. He also called my kids bicycles "litter and debris" and cited me on some top soil i had stacked on a pallet...keep in mind its spring, he also cited me for too much firewood thouh it is stacked neatly in the backyard.
In the meantime a guy less than 1000 feet from me had his entiee driveway full of firewood and junk all over his yard. I brought this to his attention and he evaded me. He still had not issued citations for that guy.
Anyways i put up a privacy fence, the birds are no longer visible. He came to my house and ASKED me if i still had the birds, i told him "i dont answer questions." He gave me a court summons.
So my plan in court is to refuse to answer if i still own chickens, my 5th amendment right. My defense will be that since he ASKED me if i still have the birds then obviously he doesnt know and saw no evidence i still had them.
Is that a decent strategy?
