My question involves a consumer law issue in the State of: Illinois
Back in April 2019 my husband bought a used 2009 Mitsubishi Galant for a 1800 from a auto repair shop, which he paid in cash. The owner's wife sign the title over to us because it was in her name. We went ahead and registered the car and bought our plates. he did not offer a bill of sale he use the fact that his machine was down so he couldn't give us a receipt and that the title we get would be our proof. A week after making the transaction we went back because the engine service light came on.when we went and told them about what was happening he told us that he was not going to work on the car because we owe him money and that there was a lien on the car. At that time we told him that it was not possible we bought the vehicle off of him in cash he told his one set amount and we paid him in full. The left his business we decided that we were going to go somewhere else trade in the car get a car that was going to be fully functional and no problems. After doing so a few days the guy from the first auto repair shop decided to go with the police and claim that the vehicle was his. By that time we already had our own title there was no lienholder it was an original title all ours. the dealership we went to told us that they didn't want to further with the transaction because the guy kept on harassing them. at that point they gave us back to title we signed to them and the car. Now back today which is June 9th 2019. Our car was parked on the street when we were heading out we noticed the car was gone. The only other person that could have taken it was the person we bought it from. we tried calling his business number because business was closed because today is a Sunday. we got ahold of personal cell phone number we called him the phone call was recorded he admitted to taking the car saying that we didn't pay him which we didn't have to because there was no lien.at this point we go to the DMV. Com to check the title status and he filed for a new title under my husband's name to get corrected and started a lien on it. The only thing we have is proof that we bought the city sticker the plates he did not give us a bill of sale. my sister was able to get the things out of the vehicle but he would not give us the car back he kept the city sticker and the plates on there and refused to give it to us unless you got the keys. at this point we already had went to the Secretary of State do you want us to attend Secretary of State Police.we're just not sure what to do anymore because the title we have originally is now avoided and they have signed for a new one.
