My question involves labor and employment law for the state of: Oregon
Hello
Can anyone advise me on a situation I am having at work. A co-worker and myself were having
a private conversation in which we were kind of making fun of our supervisor in that
she was so mean, we needed to put a cross on the door to keep her out. Just joking, nothing
profane or horrible. yes, it was probably not the smartest thing to do.
A week or so later, we were approached by human resources and advised
that "someone" heard word for word what was said and I do mean word for word. We were
the only ones in our office at the time with door shut and we were pretty sure that we were
recorded though employer/human resources will not comment. Both of us were written
up and supervisor is worse than ever now and retaliating. A co-worker who works
in the same office is now boasting to others
that she recorded myself and my other co-worker with her phone. Is this in anyway legal? Isn't
recording a private conversation without permission illegal? If the employer disciplined us
knowing it was recorded and from what I assume was done illegally, are they at fault
in their disciplinary actions? The co-worker who I had the conversation with has requested her
personnel file and also details in regards to the conversation as to who over heard, date time, etc
and the employer has refused any of it stating the notes in regards to the write up and the conversation
are confidential and do not fall into ORS652.750 (inspection of records by employee).. I feel it
is also important to mention, that my employer is a privately owned rural health/mental facility
in which they receiving funding from the state of Oregon and also over seen by a county
health administrator and so I find it odd that they would allow illegal recording and not
allow employees to review their own personnel files.
Thank you for any advice.
