My question involves court procedures for the state of: Florida; County of Collier; I am the pro se plaintiff:
After I went before the magistrate, the magistrate filed the Report & Recommendations of the Magistrate.
Within the Magistrates Report, Recommendation (MRR) the magistrate allowed for me refile within 30 days.
I did not agree with the a few items within the MRR and submitted through the courts Electronic Filing Portal "Plaintiffs Exceptions to the MRO."
I had, according to procedure 10-days to file my exception, of which I did.
Does the exception stop the clock?
I also had 30-days to refile complaint which is today.
Today just by chance I went to the portal and found that my filed "Plaintiffs Exceptions to the MRO PDF did not embed the font metrics. Whereas, 2/3 of the document is full of small squares and not legible.
My question: Is it to late for me to file the Exception? and Is it to late for me to file my answer?
Do I reach out to the JA and explain the situation? Perhaps the deputy clerk?
The exceptions important, as the defendants counsel argued and won the Punitive damages (WITH PREJUDICE).
I argue WITHOUT PREJUDICE.
Any guidance will be so helpful.
