Identity Theft: How Illegal is It to Impersonate Someone Over the Phone for Discount Abuse

My question involves criminal law for the state of: Vermont

Can you be prosecuted or sued for using somebodies employment information over the phone for purchasing at staff discount and then reselling at profit.
Talking tens of thousands of dollars. Less than 100,000$ though.

Secondly if you have authorization from this person to call on their behalf are you still liable?
