Regarding the Determination of the Number of Unused Vacation Days Upon Dismissal

The Ministry of Labour and Social Protection has prepared explanations concerning the question of the rules for determing the number of unused vacation upon dismissal.
According to the letter of the Ministry of Labour , upon dismissal, and in the event of a full year’s employment, the employee has the right to monetary compensation for a vacation in full.

However, in the event there isn’t a full year’s employment service, vacation days are to be calculated on the basis of the amount of months worked, and instances where there are less than a half of a month of service will be excluded from the calculation, while in excess of a half a month will be considered a full month’s employment.


At the same time, the right to full compensation at a rate of average earnings for the period of full vacation must be granted to employees:
- who have worked with their current employer for a period not less than 11 months subject to offset in time worked are granted the right to vacation;
- who have worked for their current employer over five and a half months in the current year and dismissed in connection to a company liquidation or staff reduction and in addition to other reasons..
