My question involves labor and employment law for the state of: North Carolina
I am trying to get an idea of what I can do. I have contacted an attorney but the consultation fee is too high for me, especially since I dont know if I even have a case. I am disabled and on intermittent fmla. Since we got a new manager she has made life hard for me. My performance Evaluation states that my work and dependability suffer due to being absent. She also told me that the unit and agency suffer due to my absences and that I should work on being absent less. Keep in mind these are fmla covered absences. I have been denied handicapped parking twice, one time because another employee needed it who did not have a right to it. I was literally told to move my car, and another time they made me move my car for another disabled person to park there because she needed it more. Even though we have been told it is first come first served. I work in a unit of 5 and we all have desk jobs. I have been given two assignments that maintenance should do which involved me walking around the building and doing some light maintenance work. None of thr other employees has ever in my seven years been asked to do this. My disease causes vertigo, dizziness, tremors my in hands and I am off balance at all times and sometimes have to use the wall,to balance myself. I did the jobs for fear of being fired. I also have to unpack cases of envelopes, which again I am the first person to do this that is not in maintenance. I have stopped working on the envelopes and emailed my boss that I was dizzy and sick and had to stop, she never even responded. I have been threatened with insubordination and termination for responding when she didnt want me to, and I have been written up for absences and time off that is covered by fmla and possible termination is in the write up.
Does anyone know what I need to do? How to file a case against them. Would,this be discrimination against my disability and fmla retaliation? Any help is greatly appreciated. On top of all this it has caused, depression stress and anxiety.
