Consumer Law Issues: Fixed Tuition Contract

My question involves a consumer law issue in the State of: Colorado

A local 6th-12 grade Private school offered the following when my child was in 4th grade:

2013 Founding Families Program
Although private school tuition has historically risen by as much as 15% per year, all newly enrolled students for the 2013-14 school year (2nd Year Founding Families) will receive a fixed tuition rate of $AB,FHE for the life of their attendance.

Once again, The Founding Families Program is being extended for a limited time to families of younger students (currently in grades K-4)...

Participation Requirements - $2,000 Contribution
Program Benefits - Future Tuition at Today's Rate


For a $2,000 contribution (per child), you can join the 2nd year Founding Families and receive the same benefit of the current year tuition rate of $AB,FHE fixed for your child during their entire ____School education. The only requirement other than your contribution is that your student apply and enter the ______ School when their elementary education is complete.

We completed the form, made the donation and enrolled our child in the school for 4 years. We were charged and paid the fixed tuition rate (along with a mandatory "activities fee" they added on later). We were unhappy with some things at the school and decided to home school last semester. A few of the issues at the school have been addressed and we are in the process of completing the application to return for the coming semester, but are being told that we forfeited our fixed rate and are being asked to pay a ~40% higher rate.

I view the form and our donation as a contract with the school. How do you interpret the language of the form. Tuition stays fixed if you leave and return, or only stays fixed if you stay continually enrolled? Any other thoughts?
