My question involves adoption law for the State of: illinois
My question is a little different probably from the rest in this forum. My fiancé has a son with another woman and she is trying to terminate his rights to the child so her husband can adopt. To keep it short but start from the beginning my fiancé was never made aware of the child during her whole pregnancy and not until a week after the child was born and that was only because the maternal grandmother chose to tell him, not the mother. My fiancé and her went to court, had a DNA test, set up visitation and childsupport. He has always paid and been up to date on his childsupport. He excercised visitation with the child till he was almost 2, only then did his ex and his best friend decided to start dating. After that everything just went down hill they married and wanted it to be just the 3 of them and my fiancé not to be in his life, he was even going to visit him and was not aloud to be called dad but "dads friend", and pressured into signing his rights over to her husband everytime he came around. Then when he wouldn't agree she told him he was not aloud to see him. It has been 6 years and although he should have taken some kind of legal action he's never wanted to put his son through all of that and knew no matter the outcome they will always make it impossible like they did then and are now. Well he finally got up the courage this past July, he messaged her told her he wanted to talk, he wanted to be part of his sons life and that he wanted them to come to some agreement and not have to go through a big battle in court but if she would t agree that he would take action. Well of course she would not come to an agreement, instead as we where filing for visitation she retaliated filing for termination of his rights and her husband to adopt him. After several months back and forth to court we finally got news the beginning of this month that we won... But it wasn't over the 17th of this month they filed for an appeal. Now it hasn't been granted and I don't know if anyone else has had anything like this happen to them and care share there experience. We don't know if it's something we should be really worried about right now because not only have we invested almost every bit of our savings into our lawyer but now she has decided to inform us that she does not do appeals,so now where left with no money to retain another lawyer.
