My question involves a child custody case from the State of: New Mexico
My sister is an non-resident alien on the OPT extension of an F1 visa. She had to take time off from work to give birth. She is in New Mexico and the baby is just 4 months. She recently got a job in Dallas, Texas. She needs to accept this job and start working in order to keep her visa status. This is the only job offer she has.
However, her husband is not letting her go for the job. He along with his parents are emotionally abusing her constantly (yelling, berating, etc). Is it possible for her to leave NM and go to TX for the job along with the child, without the husband's consent? Will she be charged with custodial inteference/kidnapping etc. The way things stand, she will either have to stay in NM, loose her visa status and have to leave the country, or go take the job with the child without the husband's consent. What are her options? Thanks
