Adoption of Children: Absent Father Contesting Stepparent Adoption

My question involves adoption law for the State of: NM

What are the necessary steps to be successful in a step parent adoption when the biological father has submitted a response to the petition & is contesting the adoption?

My son is 9 years old. My husband and I have been married for 3 1/2 years. He has been in my son's life since 2009. Biological father has abandoned my son. He has been absent for 4 years. He has had zero contact with my son. He sent 1 FB message in June asking how much money I have received from CSED and how to get back in my son's life. I sent him a link for "Second Chances" which goes over step by step guidelines for reunification/reintegration. The 1st step was to write a letter, then a phone call, then clinically supervised reintegration therapy. After sending this link, I heard nothing. No letter was received, no phone calls, nothing. There have been sporadic wage garnishments for child support.

My son is aware that he has a biological father. We have been open and honest with him any time he asks questions. The only father figure he knows is my husband, he deserves to have stability and safety in his life.

We have filed a petition, pro se, for him to adopt my son. We received a response from biological father stating he will not consent to the adoption and making claims that he has made several attempts to contact my son but has not been allowed contact. He still has made no attempt to contact my son. He is contesting the adoption out of spite. I am aware that it is best to have an attorney for adoptions however we can not afford one. I would hate for something to happen to me and he be sent to a father he doesn't know just because I cant afford an attorney.
