My question involves a traffic ticket from the state of: California
Hello everyone,
on 06/20/2015 at ~10am, I received a 22350 ticket
I was clocked going 64 in a 40 zone on a road here in Southern California. I thought the road's speed limit was 45 or higher, to be honest. I couldn't tell that I was speeding, since traffic was moving pretty quickly. Next thing I know, I'm at a left-turn-only, and a motorcycle cop pulls up behind me. As soon as I turn, he lights me up. I was very courteous and respectful with the officer, and since it was my first offense, I didn't question him. I was terrified at having my first run-in with law enforcement.
If there's a way, I'd like to fight it. I've been driving for a couple years and this is my first and only offense- and a costly one at that. $460 or so is a lot for a broke college student to cough up, and this is the only legal issue I've ever had. If I pay the lower fine and take the license point, my insurance will also be ridiculous.
The law states:
22350. No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.
Point #1:
I was on a major surface street, not a highway. Any standing with this?
Point #2:
There wasn't heavy traffic, perfect road and weather conditions were present, it was a wide road (plenty of lanes/room), and a few minutes earlier I saw some cars driving MUCH faster than I was on the same road. I don't see how my actions weren't reasonable or prudent- especially since the conditions were perfect.
Point #3:
I don't believe that I endangered my personal safety, or anyone else's safety for that matter. Nor did I risk property. Wide road with basic traffic, my car was in good condition, and I was driving in a straight line.
Point #4:
I can't really decipher what the officer wrote on the ticket, looks like:
22350 vc (L) 13663 64/40 Infraction
E60D- 414.8 C/O #1
LD PKD PDS x55
Can anyone help with breaking that down?
I appreciate ANY help I can get. I know traffic tickets are given for a reason, but if there's any way I can get it dismissed, I would be ecstatic.
