My question involves defamation in the state of: California
Two individuals (co-plaintiffs) claims that the defendant has been spreading slander about them (to the "witnesses"). Several "witnesses" have been produced as "proof of slander", all of whom are the plaintiffs' sisters / cousins / close "family friends".
The defendant has never had any communication with the sisters or the cousins of the plaintiffs, but had briefly been Facebook friends with the plaintiffs, and some of their friends, a year ago and then was unfriended by them, following a Facebook forum post that the defendant made. Defendant has not had any contact with Plaintiffs or any of the other individuals ever since.
I understand that anyone can sue anyone over anything, but isn't there any protection in the law against frivolous litigation ? How can the defendant be accused of slander if she has never had any contact with some of the "witnesses" and has not had contact with the others, for over year ? Will such a case even be allowed to file and how can the defendant fight back ? (She has no assets and is on limited, fixed income).
