My question involves a traffic ticket from the state of Washington.
I was ticketed today for going 25 in a school zone. Barry Lewis wrote:
"paragraph (3) states:
(3) A person found to have committed any infraction relating to speed restrictions within a school or playground speed zone shall be assessed a monetary penalty equal to twice the penalty assessed under RCW 46.63.110. This penalty may not be waived, reduced, or suspended.
That last sentence means you cannot even "mitigate" a school zone ticket. Many jurisdictions won't allow you to defer a school zone ticket either."
So I am wondering if I should contest at all.
This image shows red where I was stopped at a stop light, and red where my turn was (for which I naturally slowed down for). The blue circle is where the unmarked police car was parked. To be honest, I'm not sure how I got up to a "consistent 29 mph" in a block, but we'll ignore that for now. My questions are:
1. Should I wait 5 business days to turn in my ticket to see if he puts it through at all? (he pulled over at least 3 other cars after me from the same spot)
2. Should I Mitigate or Contest it? Ideally I'd like a deferral. I've been driving for 20+ years and this is the first time I've been pulled over, let alone ticketed. Driving clean for one year hardly sounds like a challenge.
3. I've downloaded Barry's form for a discovery request. My understanding is, after I select contested/mitigation, they get back to me with a court date. Then I send in the Discovery Request. Then I show up for a pre-hearing (if that's what happens in my jurisdiction -- Benton County). At the pre-hearing, I can request the deferment. Is that right?
The court is 10-15 minutes from my house so it's not a particular hardship to show up. Should I just go there and ask these questions?
