My question involves a child custody case from the State of: Texas
If the two named parties agree on a modification of an existing order and sign a paper stating the info modified without a lawyer or mediator present, then submit it to the court with jurisdiction can it upheld by the courts? Our order says that we are to seek modification through mediation first. So far some the modifications (not submitted to court) we have made held up between the both of us. However I would like something in writing for a particular request since I have given up my visitation with promise of getting it back at a later date and when I have made said request for that date having had other issues arise. Eventually I will get my time(sometimes months later) or get tired of jumping through hoops to recoup it and give up.
I'm looking at possibly losing over 100hrs of visitation over the period of three months. I would like to get something in writing stating that if I allow this in return I get to request with 14 days notice those hours back on some of the other parents time.
I just want to know what the courts will consider an agreement and what they will enforce if an issue does arise.
