My question involves a condominium located in the State of: New York
I live and own a Co-op. Back in August a tenants GAS alarm was triggered and the tenant tried to call the super. They could not reach him and then called ConEd. I believe the Police/Fire department came as well. As soon as they entered the basement, their gas detector pointed to a big gas leak in the basement. Not only was the gas leak detected in the basement, their was a gas leak to the other side of the building. They had to search to see where the other leaky pipes where located in the building. They found them and the gas was finally turned on for the whole complex in October. Every month we all pay maintenance fees. We just received our monthly maintenance fee and along with it came a letter stating that we are all responsible for the charge of replacing those pipes that had the gas leaks. They are charging me a total of $500. Everyone is in an uproar stating that they have no intentions of paying this extra charge. I'm also upset because not everyone is paying a total of $500. Some of their maintenance fees include the charge of $300. So I now know that not everyone has the same amount to pay. My question is why are we paying for the gas pipes that they should have replaced a long time ago. Isn't this the buildings responsibility? Is it legal for them to do this? Why different amounts to pay?
